S/C 190 visa is points-based visa being nominated by State/Territory Government

Must meet minimum points pass mark – 65 BUT some state/territory government MAY require a higher pass mark point.

Points are based on Age, English Language ability, Education Qualifications, employment experience and other additional points such as Aust study, location of study, single status or married status, NAATI accreditation etc. 5 points for state sponsorship.

Requirement to lodged an Expression of Interest (EOI) first, most states will not let you apply directly to them for nomination approval, many states/territories will ask you to lodge a Registration of Interest (RoI)

Need have a positive skill assessment in a nominated skilled occupation that is on the current visa nomination occupation list. Skill assessment cannot be assessment obtain for 485 visa and must NOT expired before lodging EOI and lodging visa. If the skill assessment has NO time limit on it, Dept. Immigration will NOT accept a skill assessment older than three years.

Must meet ALL criteria set out by State/Territory Government which is in addition to Immigration criteria.

ACT

The Australian government has directed ACT to nominate those who can support the economic recovery post-COVID. As such, you must meet the following criteria before you apply for the nomination:

You have worked in Canberra for the sponsor for at least 6 months

  • The visa must have a minimum of 12 months validity at time of nomination application.
  • Must be working for an ACT employer in Canberra for at least 6 months(must be paid employment, and for a minimum of 35 hours per week).

 

QLD

For the 2021–22 Skilled Migration program year, Migration Queensland will remain open until the nomination allocation (quota) is filled. For the Skilled Migration Program, Migration Queensland will only accept “decision-ready” applications. If an application is not complete or contains out-of-date documents, these applications will not be considered.

Due to the high demand, competitive nature and the limited nomination quota of the Queensland skilled migration program there is no guarantee you will be selected for state nomination, and you need to consider your alternative migration options.

Graduates of a Queensland University

  • Studied at a Queensland university/Institute
  • Completed 100% of course
  • GPA 6.0 or higher
  • Have Proficient Englishor higher
  • Have a minimum of 3 months’ work experience of at least 20 hours per week (after graduation) in the nominated or closely related occupation
  • Job offers for a minimum of 20 hours per week for 12 months

 

NSW

To be eligible for the NSW state nomination, applicants must:

  • be under 45 years of age.
  • have at least a competent level of English.
    • be currently residing in NSW and either be employed in nominated occupation or lived at least three months in NSW.

NSW nomination is competitive due to a huge amount of applications throughout the years. Therefore, you must increase your points as much as possible to maximise the chance of being nominated.

NT

Onshore applications for Northern Territory nomination under the General Skilled Migration program can now be lodged through the online application system. Offshore applications remain closed while the national border restrictions stay in place.

If you are already living in Australia

Please note the following general information:

  • if you or any of your migrating dependants are currently living interstate, you will not be eligible for the Northern Territory (NT) nomination
  • if you or any of your migrating dependants are currently on a student visa and have not completed studies in an NT institution, you will not be eligible for NT nomination
  • if you have already been nominated for a subclass 489 or 491 visa by the NT, you will not be eligible for a subclass 190 nomination.

International student graduates who have studied in the NT will be eligible for a subclass 190 nomination if you have:

  • successfully completed one or more qualifications after studying in the NT, at an NT-based institution for two years in a single tertiary course or a set of nested tertiary courses, and
  • lived in the NT for a period of at least six continuous months immediately after the date of completion of your last qualification, while holding a visa that allows full-time work (this requirement does not apply to students who completed all course requirements in semester one 2020 and produce a letter of completion dated prior to 1 August 2020), and
  • demonstrated genuine and sustained efforts to obtain employment from an NT employer in your nominated occupation or a closely related skilled occupation.
  • International student graduates who are unable to live in the NT for six months after completing two years of study in the NT will only be considered for a subclass 491 nomination. You must provide evidence of making genuine efforts to obtain employment from an NT employer in their nominated occupation or a closely related skilled occupation.
  • You will be expected to demonstrate genuine efforts and progress towards being employed in the NT in your nominated occupation both during and after your studies. These applications will be considered on a case-by-case basis.

SA

South Australia has opened its skilled migration program on 20 July 2021 for this financial year. With a total of 5,200 places allocated for both 190 and 491 nominations, South Australia has announced its changes to the migration program with the following key points:

  • Applicants residing in Australia but not in South Australia now are eligible for the South Australia under Talent and Innovator Employment Stream
  • Offshore applicants are eligible for South Australia state nomination, depending on their nominated occupations.
  • There are 3 main streams: Talent and Innovators Program, currently living and working in South Australia, and International Graduates stream.
  • For some instances, applicants do not need to work in their nominated occupation to apply for the state nomination.

The South Australian program is focused on:

  1. Talent and Innovators Program

This program is intended for skilled migrants who can contribute to South Australia’s priority sectors. It is divided into four streams:

  • Employment stream
  • Start-up and small business stream
  • Independent talent stream
    • Currently working in South Australia

This program is accessible for applicants who are:

  • Currently living and working in South Australia
  • Living and working in regional South Australia
  • Living and working in South Australia as a long-term resident
    • International Graduate of South Australia

Students who complete their studies in South Australia can access additional waivers and concessions. There are various requirements to meet before the applicant can apply for this stream. Some of the requirements include:

  • The course must be CRICOS registered with a minimum of 46 weeks.
  • A minimum of 50 % of the qualification must be completed in South Australia.
  • The applicant must reside in South Australia for at least one year during his/her studies.
  • The applicant must continue to reside in South Australia post-study.
  • For subclass 190or 491 nominations, the applicant must be working in South Australia in his/her nominated occupation.

 

TAS

Tasmanian Graduate Requirements

 

If you commence your last course of study in Tasmania after 30 June 2021, new rules will apply.

The new rules are:

  • You must have completed a course from a tertiary institution in Tasmania registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS)
  • Your course of study must be listed on CRICOS with a duration of at least 40 weeks and must have been completed full time and on-site in Tasmania.
  • You must have lived in Tasmania for at least one year from the commencement of your course and for the duration of your studies.
  • You and your dependents must be currently living in Tasmania and can provide evidence of your ongoing genuine commitment.
  • If you are not currently in skilled employment, you must provide a career plan that explains how your studies have increased your ability to find skilled work in Tasmania.
  • Your study does not need to be related to your nominated occupation; however, a relevant skills assessment will be highly regarded.
  • If you held a student visa (subclass 500), the study must be a degree, diploma or qualification directly related to the Priority Industry Training and Workshop Development Area.
  • If you held a visa that is not a student visa, the study must be directly related to the Priority Industry Training and Workshop Development Area.

 

Employment not necessary for this category

Employment is not a minimum requirement for the Tasmanian Graduate nomination category however evidence of employment or business operation will be taken into consideration in our assessment where:

  • the employer is well established and has been operating in Tasmania for at least 12 months the employment has been for more than 3 months in duration
  • the business owned by the applicant has been operating for at least 6 months, or
  • where candidates have been employed in the dairy, meat, accommodation, logistics or farming industry for at least the previous 6 months prior to lodging their application for nomination, they should have completed relevant industry training of at least Cert III (or equivalent training provided by industry peak bodies),

 

Working in Tasmania (category 2)

 

3 months minimum TSOL employment

Candidates who have a skills assessment for an occupation on the Tasmanian Skilled Occupation List will be eligible for subclass 491 nomination after working in a related position for a minimum of three months.

Acknowledgment of sponsor employer for current subclass 482 holders

To help demonstrate a genuine intention to settle in Tasmania, applicants who currently hold a Temporary Skill Shortage visa (subclass 482) and who have worked less than 12 months with their Tasmanian-based sponsoring employer must provide a letter of support from their current sponsoring employer.

Additional guidance regarding “a well-established business operating in Tasmania”

A well-established business actively operating in Tasmania would be normally be expected to have: permanent business signage

  • an active/ongoing online presence, advertising and marketing
  • a Tasmanian address as a registered business location
  • a local landline contact number
  • an ongoing office space (not a residential address) that is not ‘casual’ or ‘virtual’ (including corporate/co-shared offices), and
  • permanent representation of employees at the stated business location. ​

Semi-skilled employment – demonstrating development prospects through industry-based training

A period of industry-based training while working with their employer may demonstrate career development prospects for lower-skilled employment or substitute for existing qualifications not available in larger population centres.

 VIC

To be eligible for the Victoria state nomination, applicants must:

  • Already be living in Victoria
  • Work in a highly skilled occupation in health, medical research, life sciences, agri-food, advanced manufacturing, digital, creative industry, new energy, emissions reduction and circular economy which supports Victoria’s economic recovery and/or health response using your STEMM skills and qualifications
  • Will also accept workers in the workforce skill pathways such as hospitality occupations and early childhood teachers

 

WA

There are two streams under which WA state nominations are issues: General Stream and Graduate Stream. Depending on which lists your occupation falls into, you must apply under the suitable stream.

General Stream Eligibility

  • Occupation must be in the General Stream occupational list.
  • Must be residing in Australia;
  • Meet language requirement. This requirement depends on of occupation group.
  • Must have at least one year of Australian work experience in the nominated (or closely related) occupation over the last 10 years or at least three years of overseas work experience in the nominated (or closely related) occupation over the last 10 years.
  • Must have a genuine full-time job offer in Western Australia in your nominated occupation for at least 12 months.
  • Have sufficient settlement funds if you are not residing in Western Australia.

Graduate Stream Eligibility

  • Occupation must be in the Graduate Stream occupational list.
  • Must be residing in Australia;
  • Meet language requirement. This requirement depends on of occupation group.
  • At least two years study in Western Australia.
  • Must have at least 06 months works experience in the nominated occupation or have a six-month contract of employment in your nominated (or closely related) occupation in Western Australia.
  • Have sufficient settlement funds if you are not residing in Western Australia.
